Terms of Use for the app "MOLE: Infiltration"

Please note: The German version of these Terms of Use is the legally binding one. This English translation is provided for information purposes only.

1. Scope and provider

1.1 These Terms of Use govern the use of the application "MOLE: Infiltration" (the "App") — whether used as a mobile app or as a web app at mole-infiltration.app — provided by Sebastian Daub, c/o pro Service GmbH, Maximilianstr. 33, 97980 Bad Mergentheim, Germany (the "Provider").

1.2 The App is directed at users habitually resident in the European Union or the European Economic Area. Use outside this territory is not intended.

1.3 By using the App, you accept these Terms.

2. Description of the service

2.1 The App is a digital party game designed to be played together with people who are physically present in the same location.

2.2 Games take place exclusively in private lobbies joined via a code. There are no public lobbies with strangers.

2.3 The App is currently provided free of charge.

3. User account

3.1 Use requires signing in with a Google account, with "Sign in with Apple", or playing as a guest with an automatically generated identifier.

3.2 You must keep your credentials confidential.

3.3 An account is personal and non-transferable.

4. Minimum age

4.1 Use of the App is permitted from the age of 12.

4.2 Users between the ages of 12 and 15 may only use the App with the consent of a parent or legal guardian. By using the App you confirm that such consent has been given, if you fall within this age group.

4.3 As the App is designed to be played in person, we recommend that minors play under the supervision of a parent or guardian.

5. Rules of conduct and permitted content

5.1 Display names, profile photos and conduct towards other players must not be offensive, discriminatory, pornographic, glorify violence, constitute harassment, or otherwise be unlawful.

5.2 You warrant that you hold the necessary rights to any content you upload, in particular photographs, and that you do not infringe the rights of third parties. This expressly includes photographs depicting other people.

5.3 Violations may result in the removal of the content in question, the suspension of your account, or its deletion.

6. Content review and reporting procedure

6.1 Uploaded profile photos are automatically checked for prohibited content before publication. Images classified as prohibited are not published.

6.2 This automated check is not infallible. It neither replaces your own responsibility for the content you upload, nor does it constitute approval or endorsement by the Provider.

6.3 The App provides a reporting function allowing you to report inappropriate content or conduct by other users (notice-and-action mechanism pursuant to Art. 16 of Regulation (EU) 2022/2065). Reports are reviewed promptly.

6.4 Where a review results in the removal of content or the suspension of an account, the affected person will be informed of the reasons (Art. 17 of Regulation (EU) 2022/2065). The decision may be contested by writing to sd.creations.shop@gmail.com; we will then review the case again.

6.5 Reports must not be submitted abusively. In the event of repeated, manifestly unfounded reports, we reserve the right to restrict the reporting function for the person concerned.

7. User-generated content

7.1 For content you create or upload in the App (profile photo, display name), you grant the Provider a simple, non-exclusive and freely revocable right to display that content within the App to the other participants of the respective game round and to your friends list.

7.2 No rights beyond this are granted, in particular none for advertising or commercial exploitation.

8. Free use and future additional features

8.1 The App is currently free to use in full.

8.2 The Provider reserves the right to introduce optional paid features in the future. Users will be informed in good time beforehand. Core features that are currently free will not subsequently become chargeable.

9. Availability and changes

9.1 The Provider endeavours to keep the service running with as few interruptions as possible, but does not owe uninterrupted availability.

9.2 Features of the App may be changed, added or discontinued.

10. Term, termination and suspension

10.1 You may stop using the App at any time and delete your account yourself in the App settings. Deletion removes your personal data (see Privacy Policy).

10.2 The Provider may temporarily suspend or permanently delete accounts in the event of violations of these Terms. Where an account is suspended, the affected person will be informed of the reasons (see section 6.4).

11. Liability

11.1 The Provider is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

11.2 In the case of slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical for this type of contract. Liability is otherwise excluded to the extent permitted by law.

11.3 The Provider assumes no liability for content created or uploaded by other users.

11.4 The App is played in conjunction with activities in the physical world. The Provider is not liable for damage caused by careless behaviour while playing.

12. Changes to these Terms

The Provider may amend these Terms with effect for the future where this is necessary to adapt to changed legal or technical circumstances. Users will be informed of material changes in the App.

13. Applicable law

German law applies. Mandatory consumer protection provisions of the country in which you are habitually resident remain unaffected.

14. Language versions

The German version of these Terms of Use is authoritative. This English translation is provided for information purposes only.

15. Final provisions

Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
